Mystar.am Terms of Service with Stars

This document is an agreement between Armstar Limited Liability Company (hereinafter - mystar.am) and the Stars, defines the procedure for interaction between mystar.am and Stars, Stars and Users, as well as the procedure for the Stars to provide video recordings to Users.

By creating an account or using the mystar.am website, Star accepts these conditions, and also represents and warrants that:

a) carefully read, understand and accept this User Agreement and mystar.am Privacy Policy;

b) has the right, in accordance with applicable law, to enter into a contractual relationship under this User Agreement and there is nothing that would limit his legal capacity,

c) the Star has already turned 18 years old, and at the same time she is an adult in accordance with the legislation of the country of citizenship of the Star and the countries of his place of residence;

d) notified that the content of mystar.am is intended exclusively for adults.

Terms and Definitions :

The terms listed below have the following meanings for the purposes of this User Agreement:

Mystar.am is an online information service (website) located on the Internet, with the domain name “mystar.am”, the author, developer and copyright holder of which is “Armstar” Limited Liability Company. The online service allows you to upload, send, store, receive content and various data, including mystar videos and promotional materials.

Website is a set of graphic and information materials, as well as computer programs and databases, ensuring their availability on the Internet at the network address https: // mystar.am, where mystar.am is located.

Mystar.am ‘s  administration employees authorized to manage mystar.am, acting on behalf of mystar.am.

A mystar.am Star is a person who is popular in a particular field of activity, which includes: artists, actors, showmen, bloggers, athletes, businessmen, politicians, etc., who have registered in mystar.am personal account through the Internet and using the mystar.am website.

A User of mystar.am is a person who has access to the mystar.am website via the Internet and uses the mystar.am website.

Personalized Video of Star  is a video message recorded by a Star at the request and request of the User, the duration of which cannot be less than 30 seconds.

The content of mystar.am is the protected results of intellectual activity, including texts of literary works, their titles, forewords, annotations, articles, illustrations, covers, musical works with or without text, graphic, text, photographic, derivative, composite and other works, custom interfaces, visual interfaces, trademark names, logos, computer programs, databases, as well as design, structure, selection, coordination, appearance, general style and location of this content included in mystar.am and other intellectual property objects all together and / or separately contained on mystar.am.

1. General terms of interaction and the subject of the user agreement

1.1. The use of mystar.am materials and services is governed by the norms of the current legislation of the Republic of Armenia.

1.2. This Agreement is a public offer. By accessing mystar.am, a Star is deemed to have acceded to this Agreement.

1.3. Mystar.am ‘s  administration has the right to:

1.3.1. at any time to unilaterally change the terms of this Agreement. Such changes come into force from the moment the new version of the Agreement is posted on mystar.am. If the Star disagrees with the changes made, it has the right to refuse access to mystar.am, stop using the materials and services of mystar.am;

1.3.2. restrict Star's access to Mystar.am in the event that Star violates the terms of this Agreement;

1.3.3. change the amount of payment charged for the rendered services by mystar.am.

1.4. In accordance with the terms of this Agreement, the Star, upon the order and assignment of the User through the mystar.am website, undertakes to record, upload to the mystar.am personal account and transfer the mystar personalized  video to the User, for which mystar.am pays the Star a remuneration in the form of 70% of income, received from each User who ordered and paid for the Star's services within 7 (working) days.

1.4.1. The star has the right to independently set the price for each mystar video. Moreover, this price cannot be less than 5000 AMD (Armenian) for one mystar video.

1.5. Mystar.am provides the Star with the following types of services:

• registration (creation) of a personal account, with various statistical data, as well as the ability to receive applications and upload mystar videos;
• access to all mystar.am services both free of charge and on a paid basis;
• access to search and navigation tools mystar.am;
• acceptance and transfer of payments;
• other types of services sold on the pages of mystar.am.

1.6. Payment of remuneration to the Star is made within 3 days after the User's funds are received in the Cloudpayments online payment service. The online payment service is not operated by mystar.am and the relationship with the service is governed by its terms https://cloudpayments.ru/wiki/podkluchenie/poryadok_podkluchenia/oferta. Consequently, mystar.am is not responsible for any delays or disruptions in receiving payment caused by a third party service.

1.7. All existing (actually functioning) mystar.am services , as well as any subsequent modifications and additional mystar.am services appearing in the future, are covered by this Agreement.

2. About the obligations of the Star, the procedure for interaction with mystar.am and the Users, as well as the rights to the results of intellectual activity

2.1. The star undertakes to record, upload to mystar.am personal account and transmit the personalized video to each User who orders it.

At the same time, provided that it is not possible to fulfill the User's request, the Star has the right to reject the request within a period (from 3 to 7 days) of the moment of its receipt. If the request is accepted, the video must be uploaded to your personal account within a period (from 3 to 7 days) of the moment of acceptance. In case of rejection, the User receives a corresponding notification.

2.2. When creating a video mystar, the star undertakes to act strictly within the framework of the User's assignment.

2.3. The star also has the right to reject the User's request if it is undesirable, contains offensive language, obscenities, calls for inciting ethnic hatred or enmity, violation of laws, etc.

2.4. If the request is rejected, mystar.am will not pay any money to Star.

2.5. After completing registration and creating an account, Star undertakes to provide mystar.am with the following information: 1. one high-resolution image; 2. biography; 3. social networks; 4. payment details, 5. other information.

2.6. Star agrees not to take actions that may be considered as violating the legislation of the Republic of Armenia or the norms of international law, including the field of intellectual property, copyright and / or related rights (the Law of the Republic of Armenia on Copyright and Related Rights), as well as any actions, which lead or may lead to disruption of the normal operation of mystar.am and mystar.am services.

2.7. The mystar.am website allows the Star to upload, send, store, receive various content, including mystar videos and promotional materials. The star retains the rights to all results of intellectual activity.

If the User wishes to use the Content (purchased on Mystar.am) for commercial purposes, it is necessary to come to an agreement with the Star through the Mystar.am administration.

2.8. By downloading, submitting, storing or receiving content, the Star grants mystar.am permission to reproduce and use any of the Star's content. The star grants mystar.am and those who work in conjunction with mystar.am with a license to use, post, store, reproduce, modify, create derivative works (such as translations, adaptations or other changes that we make for the correct operation of mystar.am ), public display and distribution on the Site, on social networks, on other sites and in the media.

2.9. Star's content is not exclusive, that is, the Star has the right to use its content for personal purposes or allow third parties to use the Star's content for their own purposes.

2.10. Mystar.am does not pay the Star any remuneration in connection with the use of the Star's content. Mystar.am has the right to use the content all over the world. In addition, mystar.am has the right to delegate the rights granted to Users and use it in any other way, if it is necessary for the activities of mystar.am.

2.11. The right to the content is unlimited and remains valid even after the Star stops using mystar.am.

2.12. The Star agrees that mystar.am has the right to display, distribute, broadcast and otherwise use advertisements that include Star's content.

2.13. By accepting this Agreement, Star represents and warrants that:

• all rights to the content belong to the Star legally and the Star has the right to grant mystar.am the rights described above;
  • The Star will pay in full any fees or other charges if such arise in connection with the use of the content posted on Mystar.am by the Star for its own commercial purposes.
•  Star Content does not violate intellectual property rights, privacy rights, does not defame honor, dignity and business reputation and does not violate other legal rights of third parties.

2.14. Star acknowledges and agrees that the relationship governed by this Agreement is not confidential, fiduciary or other special relationship. Mystar.am is not responsible for any use or disclosure of any content provided by Star.

2.15 Mystar.am has the right to refuse a Star in receiving or transmitting content without giving any reason. In addition, mystar.am has the right to remove the Star's content from the mystar.am website in the event that the Star deviates from the correct fulfillment of the User's task.

2.16. In the event that Star cancels mystar account, Star has the right to require mystar.am to no longer display Star's videos on the website. At the same time, mystar.am cannot restrict the use of the Star's videos by the Users for whom the Star created them.

2.17. When citing materials posted on mystar.am, including copyrighted works, a link to mystar.am is required (Law of the Republic of Armenia on Copyright and Related Rights).

2.18. The Star's content on mystar.am should not contradict the requirements of the legislation of the Republic of Armenia and the generally accepted norms of morality and ethics.

2.19. The star has been warned that the mystar.am Administration is not responsible for visiting and using external resources, links to which may be contained on mystar.am.

2.20. The Star agrees that the mystar.am ’s Administration is not responsible and has no direct or indirect obligations to the Star in connection with any possible or incurred loss or damage related to any content of mystar.am, copyright registration and information about such registration, goods or services available on mystar.am or obtained through external sites or resources.

2.21. The star accepts the position that all materials and services of mystar.am or any part of them may be accompanied by advertising. The star agrees that the administration of mystar.am does not bear any responsibility and does not have any obligations in connection with such advertising.

2.22. In addition, the Star mystar.am undertakes:

2.22.1. Provide, upon the request of the Administration of mystar.am, additional information that is directly related to the services provided by mystar.am.

2.22.2. Observe the property and non-property rights of authors and other rightholders when using mystar.am.

2.22.3. Do not take actions that may be considered as disrupting the normal operation of mystar.am.

2.22.4. Not to disseminate any confidential and protected by the legislation of the Republic of Armenia information about individuals or legal entities using mystar.am.

2.22.5. Avoid any actions that may violate the confidentiality of information protected by the legislation of the Republic of Armenia.

2.22.6. Do not use mystar.am to disseminate advertising information, except with the consent of the mystar.am  Administration.

2.22.7. Do not use mystar.am ‘s services for the purpose of:

2.22.7.1. uploading content that is illegal violates any rights of third parties; promotes violence, cruelty, hatred and (or) discrimination on racial, ethnic, gender, religious, social grounds; contains inaccurate information and (or) insults to specific persons, organizations, authorities.

2.22.7.2. inducement to commit illegal actions, as well as assistance to persons whose actions are aimed at violating the restrictions and prohibitions in force on the territory of the Republic of Armenia.

2.22.7.3. violation of the rights of minors and (or) causing them harm in any form.

2.22.7.4. infringement of the rights of minorities.

2.22.7.5. representing oneself as another person or representative of an organization and (or) community without sufficient rights, including for mystar.am employees.

2.22.7.6. misleading about the properties and characteristics of any service on mystar.am.

2.22.7.7. incorrect comparison of mystar.am, as well as the formation of a negative attitude towards persons (not) using mystar.am, or condemnation of such persons.

2.23. The Star is prohibited:

2.23.1. Use any devices, programs, procedures, algorithms and methods, automatic devices or equivalent manual processes to access, acquire, copy or track mystar.am content;

2.23.2. Disrupt the proper functioning of mystar.am;

2.23.3. In any way bypass the navigation structure of mystar.am to receive or attempt to obtain any information, documents or materials by any means that are not specifically provided by mystar.am services;

2.23.4. Unauthorized access to mystar.am functions, any other systems or networks related to mystar.am, as well as any services offered on mystar.am;

2.23.4. Violate the security or authentication system on mystar.am or on any network related to mystar.am.

2.23.5. Do a reverse search, track or try to track any information about any other user of mystar.am.

2.23.6. Use mystar.am and its Content for any purpose prohibited by the legislation of the Republic of Armenia, as well as incite any illegal activity or other activity that violates the rights of mystar.am or others.

3. Using mystar.am

3.1. The website and the content included in the Website is owned and operated by the mystar.am Administration.

3.2. The content of the Website may not be copied, published, reproduced, transmitted or distributed in any way, as well as posted on the global Internet without the prior written consent of the mystar.am Administration.

3.3. The content of the Website is protected by copyright, trademark law, as well as other intellectual property rights and unfair competition laws.

3.4. For the purchase of goods and services offered on mystar.am, it is required to create (register) a Star account with the provision of a phone number and e-mail.

3.5. The Star is personally responsible for maintaining the confidentiality of account information, including the password, as well as for all, without exception, activities that are conducted on behalf of the Account Star.

3.6. The star must immediately notify the mystar.am Administration about unauthorized use of his account or password or any other breach of the security system.

3.7. The site administration has the right to unilaterally cancel the Star's account if it has not been used for more than 12 consecutive calendar months without notifying the Star.

3.7. This Agreement applies to all additional terms and conditions for the purchase of goods and the provision of services provided on mystar.am.

3.8. The mystar.am administration has the right, at any time, without notifying the Star, to make changes to the list of goods and services offered on mystar.am, and (or) to the prices applicable to such goods for their sale and (or) the services provided by mystar.am.

 

4. Responsibility

 

4.1. Any losses that a Star may incur in the event of intentional or reckless violation of any provision of this Agreement, as well as due to unauthorized access to the communications of another Star, are not reimbursed by the Administration of mystar.am.

4.2. Mystar.am administration is not responsible for:

4.2.1. Delays or failures in the process of performing transactions arising from force majeure, as well as any case of malfunctions in telecommunications, computer, electrical and other related systems.

4.2.2. Actions of transfer systems, banks, payment systems and for delays associated with their work.

4.2.3. The proper functioning of the website if the Star does not have the necessary technical means to use it, and also does not bear any obligation to provide users with such means.

 

5. Violation of the terms of the User Agreement

5.1. The mystar.am administration has the right to disclose any information collected about the Star, if the disclosure is necessary in connection with an investigation or complaint regarding the misuse of mystar.am or to establish (identify) a Star that may violate or interfere with the rights of the mystar.am Administration or rights other Stars and Members of mystar.am.

5.2. The mystar.am administration has the right to disclose any information about the Star that it considers necessary to comply with the provisions of the current legislation or court decisions, ensure compliance with the terms of this Agreement, protect the rights or safety of Armstar LLC or Users.

5.3. The mystar.am administration has the right to disclose information about a Celebrity if the current legislation of the Republic of Armenia requires or permits such disclosure.

5.4. The mystar.am administration has the right to terminate and (or) block access to mystar.am without prior notice to the Star if the Star has violated this Agreement or the terms of use of mystar.am contained in other documents, as well as in case of termination of the website or due to a technical problem or Problems.

5.5. The site administration is not responsible to the Star or third parties for the termination of access to mystar.am in the event of violation by the Star of any provision of this Agreement or other document containing the terms of use of mystar.am.

6. Other conditions

6.1. All possible disputes arising from this Agreement or related to it shall be resolved in accordance with the current legislation of the Republic of Armenia at the location of mystar.am.

6.2. Nothing in the Agreement can be understood as the establishment between the Star and the Mystar.am Administrator of an agency relationship, partnership relationship, joint activity relationship, personal employment relationship, or any other relationship not expressly provided for in the Agreement.

6.3. The recognition by the court of any provision of the Agreement as invalid or not subject to enforceability does not entail the invalidity of other provisions of the Agreement.

6.4. Inaction on the part of the Mystar.am Administration in the event of violation by any of the Stars of the provisions of the Agreement does not deprive the mystar.am Administration of the right to take later appropriate actions in defense of its interests and protection of copyrights (the Law of the Republic of Armenia on Copyright and Related Rights) protected in accordance with the legislation materials mystar.am.

 

The star confirms that she is familiar with all the clauses of this User Agreement and unconditionally accepts them.
