Mystar.am User Agreement

This document is an agreement between Armstar Limited Liability Company (consequently Mystar) and the Users, defines the procedure for the use by the Users of the materials and services of Mystar, located on the website https://www.mystar.am/. By using the mystar.am website, the User accepts these conditions, and also represents and warrants that:

a) carefully read, understand and accept this User Agreement and Privacy Policy;

b) has the right, in accordance with the applicable law, to enter into a contractual relationship under this User Agreement and there is nothing that would limit his legal capacity;

c) the User has already turned 18 years old, and at the same time he is an adult in accordance with the legislation of the country of citizenship of the User and the countries of his residence;

d) notified that mystar content is intended exceptionally for adults.

Terms and Definitions:

The terms listed below have the following meanings for the purposes of this User Agreement:

Mystar.am is an online information service (website) located on the Internet, with the domain name “mystar.am”, the author, developer and copyright holder of which is the Limited Liability Company "Armstar". The online service allows you to upload, send, store, receive content and various data, including videos and promotional materials from Mystar. Website - a set of graphic and information materials, as well as computer programs and databases, ensuring their availability on the Internet at the network address https://www.mystar.am/., where mystar.am is located. Mystar.am administration - employees authorized to manage Mystar.am, acting on behalf of Mystar.am. A Star of Mystar.am is a person who is popular in a particular field of activity, which includes: artists, actors, showmen, bloggers, athletes, businessmen, politicians, etc., who have registered in the personal account of mystar.am, through the Internet and by using the Mystar.am website. Mystar.am user is a person who has access to the Mystar.am website via the Internet and uses the Mystar.am website. Mystar Video is a video message (video) recorded by a Star by the request and assignment of the User, the duration of which cannot be less than 30 seconds  and not more than 5 minutes. The content of Mystar.am is the protected results of intellectual activity, including the texts of literary works, their titles, forewords, annotations, articles, illustrations, covers, musical works with or without text, graphic, text, photographic, derivative, composite and other works, custom interfaces, visual interfaces, trademark names, logos, computer programs, databases, as well as design, structure, selection, coordination, appearance, general style and location of this content included in Mystar.am and other intellectual property objects all together and / or separately contained on Mystar.am.

1. General terms of interaction and the subject of the User Agreement

1.1. In accordance with the terms of this Agreement, the User has the right to make an individual order for a video message through the Mystar.am website from a Star for the fee specified in the Star's personal account.

1.2. How the order is made:

The user submits a request containing the task through the Mystar.am website to any Star. At the same time, the Star has from 3 to 7 days to accept or reject the User's request. The content of the completed order (language, wishes of the User, etc.) will depend on the content of the Star's task, the timing of the video should not be less than 30 seconds. All rights to the material submitted by the User for creating mystar video belong to the User. The User also guarantees that he has received all permissions to use Star's material provided by the User. The user is solely responsible for providing the material to Star without the appropriate permissions of third parties. The user is warned that the creation of mystar video by Star is the result of Star's creative activity, and therefore minor deviations from the literal and literal fulfillment of the order are allowed. In this connection, the User does not have the right to demand a refund of the paid amounts from the Stars and Mystar. The funds are returned to the User only in case of the significant departure from the order. If it is impossible to fulfill the order after its acceptance, the User is notified of this and the paid money is returned to him.

1.3. For placing an order for a Mystar video from a Star, the User is charged a fee indicated in the Star's personal account, the size of which is set by the Celebrity and indicated on the Mystar.am website. Payment for mystar video by the User is made simultaneously with the sending of the request. If the User's request is rejected by the Star, the paid funds are returned to the User in full size. The creation of a video by Star takes 3-7 days from the moment the corresponding order is sent and paid for.

1.4. Upon receipt of full payment by Mystar, the User is entitled to use the ordered Mystar video for personal, commercial and non-commercial purposes. Mystar videos are licensed and not sold, the User may not resell his rights to Mystar videos to third parties, and the User may not use and distribute Mystar videos owned by the third parties without the consent of the User (owner). Each Mystar video is the property of the User (customer).

1.5. The use of Mystar materials and services is governed by the norms of the current legislation of the Republic of Armenia.

1.6. This Agreement is a public offer. By accessing the Mystar.am website, the User is considered to have acceded to this Agreement.

1.7. The Mystar administration has the right to:

1.7.1. at any time to unilaterally change the terms of this Agreement. Such changes come into force from the moment the new version of the Agreement is posted on the Mystar.am website. If the User disagrees with the changes made, he is obliged to refuse access to the Mystar.am website, stop using the materials and services of Mystar;

1.7.2. restrict the User's access to the Mystar.am website if the User violates the terms of this Agreement;

1.7.3. change the amount of payment charged for the services provided by Mystar.

1.8. The subject of this Agreement is to provide the mystar User with access to the services and services contained on the Mystar.am website.

1.8.1. The Mystar.am website provides the User with the following types of services:

a) access to all goods and services provided by Mystar;

b) access to all Mystar services, both free and paid, for example, choosing a star, watching previously released videos;

c) access to electronic content on a free basis, with the right to purchase paid services;

f) access to search and navigation tools on the Mystar.am website;

g) other types of services sold on the Mystar.am website.

1.8.2. This Agreement covers all existing (actually functioning) services of Mystar at the moment, as well as any subsequent modifications and additional services of Mystar that appear in the future.

2. Obligations of the User

2.1. The user agrees not to take actions that may be considered as violating the legislation of the Republic of Armenia or the norms of international law, including in the field of intellectual property, copyright and / or related rights (the Law of the Republic of Armenia on Copyright and Related Rights), as well as any actions, which lead or may lead to disruption of the normal operation of the mystar.am website and Mystar services.

2.2. The User is warned that the Star has the right to reject the User's request for any reason, as well as in cases where it is undesirable, contains offensive language, obscenities, calls for inciting ethnic hatred or enmity, violation of laws, etc.

2.3. The use of Mystar materials without the consent of the copyright holders is not allowed (the Law of the Republic of Armenia on Copyright and Related Rights). For the legitimate use of mystar materials, it is necessary to conclude licensing agreements (obtaining licenses) from the Copyright Holders.

2.4. When citing Mystar materials, including copyrighted works, a link to the Mystar.am website is required (Law of the Republic of Armenia on Copyright and Related Rights).

2.5. Comments and other entries of the User on the Mystar.am website should not contradict the requirements of the legislation of the Republic of Armenia and the generally accepted norms of morality and ethics.

2.6. The user is warned that the Administration of the Mystar.am website is not responsible for visiting and using external resources, links to which may be contained on the Mystar.am website.

2.7. The User agrees that the mystar Administration is not responsible and has no direct or indirect obligations to the User in connection with any possible or incurred losses or damages related to any content of the Mystar.am website, copyright registration (Law of the Republic of Armenia on Copyright and Related Rights) and information about such registration, goods or services available on or obtained through external sites or resources or other contacts of the User that he entered using the information posted on the mystar.am website or links to external resources.

2.8. The user accepts the provision that all materials and services of Mystar or any part of them may be accompanied by advertising. The user agrees that the Administration of the Mystar.am website does not bear any responsibility and does not have any obligations in connection with such advertising.

2.9. The user acknowledges and agrees that the relations governed by this Agreement are not confidential, fiduciary or other special relations. Mystar is not responsible for any use or disclosure of any content provided by the User.

2.10. In addition, the user of the Mystar website undertakes:

2.10.1. Provide, upon the request of the Administration of the Mystar.am website, additional information that is directly related to the services provided.

2.10.2. Observe the property and non-property rights of authors and other copyright holders when using the mystar.am website.

2.10.3. Do not take actions that may be considered as disrupting the normal operation of the Mystar.am website.

2.10.4. Not to disseminate any confidential and protected by the legislation of the Republic of Armenia information about individuals or legal entities using the Mystar.am website.

2.10.5. Avoid any actions that may violate the confidentiality of information protected by the legislation of the Republic of Armenia.

2.10.6. Do not use the Mystar.am website to disseminate advertising information, except with the consent of the Mystar.am website Administration.

2.10.7. Do not use Mystar services for the purpose of:

2.10.7.1. uploading content that is illegal violates any rights of third parties; promotes violence, cruelty, hatred and (or) discrimination on racial, ethnic, gender, religious, social grounds; contains inaccurate information and (or) insults to specific persons, organizations, authorities.

2.10.7.2. inducement to commit illegal actions, as well as assistance to persons whose actions are aimed at violating the restrictions and prohibitions in force on the territory of the Republic of Armenia.

2.10.7.3. violation of the rights of minors and (or) causing them harm in any form.

2.10.7.4. infringement of the rights of minorities.

2.10.7.5. representing yourself as another person or representative of an organization and / or community without sufficient rights, including for Mystar employees.

2.10.7.6. misleading about the properties and characteristics of any Mystar service.

2.10.7.7. incorrect comparison of Mystar, as well as the formation of a negative attitude towards persons (not) using the Mystar website, or condemnation of such persons.

2.11. The User is prohibited from:

2.11.1. Use any devices, programs, procedures, algorithms and methods, automatic devices or equivalent manual processes to access, acquire, copy or track the content of the Mystar.am website;

2.11.2. Disrupt the proper functioning of the Mystar.am website;

2.11.3. In any way bypass the navigation structure of the Mystar.am website to receive or attempt to obtain any information, documents or materials by any means that are not specifically presented by the mystar.am website;

2.11.4. Unauthorized access to Mystar functions, any other systems or networks related to the mystar.am website, as well as to any services offered on the Mystar.am website;

2.11.5. Violate the security or authentication system on the Mystar.am website or on any network related to Mystar.

2.11.6. Reverse search, track, or attempt to track any information about any other Mystar user.

2.11.7. Use Mystar video for any purpose prohibited by the legislation of the Republic of Armenia, as well as incite to any illegal activity or other activity that violates the rights of the Mystar.am website or other persons.

3. The Use of Mystar.am website

3.1. The website and the content that is part of the Website is owned and operated by the Mystar.am website administration

3.2. The content of the Website may not be copied, published, reproduced, transmitted or distributed in any way, as well as posted on the global Internet without the prior written consent of the Administration of the Mystar.am website.

3.3. The content of the Website is protected by copyright, trademark law, as well as other intellectual property rights and unfair competition laws.

3.4. This Agreement applies to all additional terms and conditions for the purchase of goods and the provision of services provided on the Mystar.am website.

3.5. The information posted on the Mystar.am website should not be construed as a change to this Agreement.

3.6. The administration of the Mystar.am website has the right at any time without notifying the User to make changes to the list of goods and services offered on the Mystar.am website, and (or) to the prices applicable to such goods for their sale and (or) the services provided by Mystar.

4. Responsibility

4.1. Any losses that the User may incur in the event of intentional or reckless violation of any provision of this Agreement, as well as due to unauthorized access to communications of another User, are not reimbursed by the Administration of the Mystar.am website.

4.2. Mystar.am website administration is not responsible for:

4.2.1. Delays or failures in the process of performing transactions arising from force majeure, as well as any case of malfunctions in telecommunications, computer, electrical and other related systems.

4.2.2. Actions of transfer systems, banks, payment systems and for delays associated with their work.

4.2.3. The proper functioning of the website if the User does not have the necessary technical means to use it, and also does not bear any obligation to provide users with such means.

5. Violation of the terms of the User Agreement

5.1. The administration of the Mystar.am website has the right to disclose any information collected about the User of this Website, if disclosure is necessary in connection with an investigation or complaint regarding the misuse of the mystar.am website or to establish (identify) a User who may violate or interfere with the rights of the Mystar Administration.

5.2. The administration of the Mystar.am website has the right to disclose any information about the User, which it considers necessary to comply with the provisions of the current legislation or court decisions, ensure compliance with the terms of this Agreement, protect the rights or safety of Armstar LLC, Users.

5.3. The administration of the Mystar.am website has the right to disclose information about the User if the current legislation of the Republic of Armenia requires or permits such disclosure.

5.4. The administration of the Mystar.am website has the right to terminate and (or) block access to the Mystar.am website without prior notice to the User if the User has violated this Agreement or the terms of use of the Mystar.am website contained in other documents, as well as in the event of termination of the Website or due to technical problem or problem.

5.5. The site administration is not responsible to the User or third parties for the termination of access to the mystar.am site in case of violation by the User of any provision of this Agreement or other document containing the terms of use of the Mystar.am site.

6. Other conditions

6.1. All possible disputes arising from or related to this Agreement shall be resolved in accordance with the current legislation of the Republic of Armenia at the location of the Mystar.am website.

6.2. Nothing in the Agreement can be understood as the establishment between the User and the Administration of the mystar.am website of agency relations, partnership relations, joint activity relations, personal employment relations, or any other relations not expressly provided for by the Agreement.

6.3. The recognition by the court of any provision of the Agreement as invalid or not subject to enforceability does not entail the invalidity of other provisions of the Agreement.

6.4. Inaction on the part of the Administration of the Mystar.am website in case of violation by any of the Users of the provisions of the Agreement does not deprive the Administration of the Mystar.am website of the right to take later appropriate actions in defense of their interests and protection of copyrights (Law of the Republic of Armenia on Copyright and Related Rights) on Mystar materials protected in accordance with the law.

 

The User confirms that he is familiar with all the clauses of this User Agreement and unconditionally accepts them.
